Advanced Storytelling in Criminal Cases: Strategies, Persuasion, and Techniques

This interactive session is designed to help attendees develop effective storytelling strategies for their criminal cases. The goal is to equip participants with persuasive techniques that enable them to achieve the desired outcomes for their often marginalized clients.

Presentation Goals in Criminal Cases

1. Developing a Storytelling Strategy
A successful storytelling strategy begins by clearly defining both the purpose and the audience for your case. The primary objective is to influence how the finder perceives the facts and ultimately makes decisions. To accomplish this, it is essential to identify the core message you wish to convey. An effective action plan involves gathering and organizing relevant content and setting appropriate timelines for each stage of the case presentation.

2. Persuasion
Persuasion in criminal cases relies on the use of compelling narratives that make facts both memorable and relatable. 
Several techniques are vital to achieving this:
· Emotional Appeals: Engage the audience’s emotions to strengthen the impact of the narrative.
· Framing Evidence: Present evidence within a coherent story to provide context and meaning.
· Humanizing Experiences: Share your client’s stories and experiences to foster empathy and understanding.

Persuasive communication also requires clarity, ensuring that facts and legal arguments are easy to understand. Building credibility through consistency and honesty helps to establish trust with the audience. Strong connections are formed by engaging the audience both emotionally and intellectually. It is essential to ensure retention so that the fact finder remembers your key points. Ultimately, advocacy is about advancing your client’s position ethically and effectively.

Developing a clear narrative structure is key to successful storytelling.

Cell phones extractions are digital copies of a client or witness' mobile device that often contain a voluminous amount of data which can be daunting to navigate or even access. This session is designed to provide an overview of cell phone forensic reports generated in the extraction process, frequently through programs like Cellebrite or Magnet, with a goal of assisting users in navigating this data to identify information that may be useful for representation of the client.

In this era of unprecedented political change, where the momentum of criminal justice reform and social justice has halted at the fifth anniversary of the George Floyd Era, the public defender shines as a beacon of equity and equality. This session speaks to our times and highlights the role of criminal defense mitigation and its particular micro, mezzo, and macro roles in achieving an equitable America. Adapted from Donavan’s new book, Mitigating Gideon,  it expounds on cultural humility and a culturally competent criminal defense mitigation model, presenting philosophy and practice to build, augment, and sustain a consistent practice of culturally competent mitigation relevant to the public defender mandate and its place amid the challenged vestiges of social justice and criminal justice reform.
